DECEASED ESTATES & SURVIVORSHIP APPLICATION

  • Certify the documents required to evidence your name change

  • Attend settlement on your behalf

SEPARATION/DIVORCE TRANSFERS

If you have recently separated or divorced and you have court orders stipulating transfer of your property to you or your ex-partner, we can assist in executing the required transfer.  We will:

  • Ensure stamp duty is appropriately assessed having regard to the court order

  • Prepare the relevant documents to be lodged with Landgate

  • Liaise with your lender and attend settlement on your behalf

OFF THE PLAN

PURCHASES

An off-the-plan purchase refers to a purchase of property that occurs prior to the certificate of title being issue or prior to completion of the property.  The process is often quite complex and lengthy.  In assisting you to ensure a smooth and timely settlement:

  • We will liaise with your property developer;

  • Maintain contact with your lender or finance broker to ensure finance is on track

  • Prepare all necessary documentation and attend settlement on your behalf

PRIVATE CONTRACTS

If you are purchasing or selling a property without the assistance of a real estate agent, you will need to prepare a written contract for sale of the property in question.  We can assist you with this, and will ensure:

  • The contract reflects your understanding of what you have agreed to

  • The contract protects your interests

  • Liaise with relevant parties to assist in negotiation

Settlement for BUYERS

  • Contact the relevant government departments including local government to ensure stamp duty is calculated correctly and paid at settlement, council rates are adjusted, and relevant documents are lodged with Landgate.

  • Liaise with your real estate agent to ensure all outstanding matters relating to the Contract of Sale are addressed prior to settlement.

  • Communicate with your finance broker (or directly with your lender) to ensure accurate calculation of funds required for settlement will be available and where relevant, ensure any existing mortgages are discharged.

Settlement for SELLERS
